Claimed Terms of Use

These Terms of Use ("Terms") govern your access to and use of Claimed, including our mobile application, and all associated services and content (collectively, the "Services"). These Terms form a binding agreement between you and Claimed ("Company," "we," or "us").
By using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
Eligibility
You must be at least 18 years old and reside in the United States or its territories to use Claimed. By using the Services, you represent and warrant that you meet these eligibility requirements.
Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you (e.g., via app or email). Continued use of the Services after updates means you accept the revised Terms.
Account & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at support@tryclaim.app if you suspect unauthorized access.
You may not create more than one account. We reserve the right to withhold refunds or suspend access if abuse is detected.
Use of Services
You may use Claimed only for lawful, personal, and non-commercial purposes. You agree not to:
- Violate any law or regulation
- Submit false, misleading, or fraudulent information
- Engage in spamming, scraping, or unauthorized data collection
- Interfere with the functioning of the Services
- Use automated tools or resell access without written consent
Class Action Claimed Services
Claimed simplifies the process of filing class action settlement claims.
- You do not need Claimed to file a claim; you can submit it directly to the settlement administrator.
- Claimed is not affiliated with any law firm, settlement administrator, or court.
- Claimed does not provide legal advice and is not a law firm. For legal questions, consult an attorney.
- We are not responsible for claim outcomes, processing timelines, or payments determined by third parties.
You are solely responsible for reviewing all information before submitting a claim. Claimed is a document automation and submission tool. We do not interpret legal rights or represent you.
Fees & Auto-Renewal
Claimed charges a service fee of $6.99 per week, and $49,99 per year, depending on your subscription. This is a recurring subscription.
By subscribing, you agree to automatic renewal unless canceled. You may cancel at any time through your account settings or by contacting info@theirec.com, Claimed will provide clear renewal terms and cancellation instructions prior to renewal.
Refund Policy
All membership purchases are non-refundable once processed, as claims are submitted in real time and cannot be withdrawn or canceled.
If you initiate a chargeback without first contacting our support team for a refund request, your access to the Services may be permanently revoked.
Money-Back Guarantee
We offer a money-back guarantee on the annual Claimed membership. If you have not received at least the total amount you paid in membership fees, we will refund you the difference.
To qualify for a refund:
- You must have held an active membership for at least 12 months from the date of your first payment.
- You must have submitted at least 10 valid claims during that time.
- All submitted claims must have passed their respective payout dates (typically 3–15 months after each claim's deadline).
- None of your claims may have been denied due to fraud, inaccuracy, or incomplete information.
- You must submit your refund request within 30 days of the final Claimed Payout Date.
We reserve the right to request supporting documentation and to deny refund requests that appear to be made in bad faith.
Example:
If you paid $49.99 in annual membership fees and received only $30 in claim payouts after 12 months, Claimed will refund you the difference of $19.99.

Data & Privacy
We collect and use your data in accordance with our Privacy Policy. You may request data deletion at any time by emailing info@theirec.com with the subject line "Data Deletion Request."
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We make no guarantees that:
- The Services will be uninterrupted or error-free
- Information provided will be complete or up to date
- Any claim will be approved or paid
Taxes
You are solely responsible for any taxes associated with payments you receive from claim settlements.
Dispute Resolution & Arbitration
Most issues are resolved by contacting info@theirec.com. If not, both parties agree to resolve disputes through binding individual arbitration under AAA rules in Austin, TX.
Class actions and jury trials are waived.
You may opt out of arbitration within 30 days by emailing info@theirec.com with your name, address, and a clear statement that you wish to opt out.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
CLAIMED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMED SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO CLAIMED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIMED, OR (B) $100.
Indemnification
You agree to indemnify, defend, and hold harmless Claimed, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, liabilities, costs, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your false or misleading submissions
Governing Law
These Terms are governed by the laws of California. Any disputes shall be resolved in Austin, Texas, unless subject to binding arbitration.
Miscellaneous
- Force Majeure: We are not liable for delays due to events beyond our control.
- Assignment: You may not assign your rights under these Terms without our written consent.
- Entire Agreement: These Terms and our Privacy Policy represent the full agreement between you and Claimed.
- Severability: If any part is held invalid, the rest remains enforceable.
- Waiver: Our failure to enforce a provision does not constitute a waiver of that right.
